Terms of Service
These terms govern your use of this website and any purchase you make from Rotten Fragrances. By browsing the site or placing an order, you agree to them. The names of our fragrances are jokes. This document is not.
1. Agreement to these terms
These Terms of Service form a binding agreement between you and Rotten Fragrances. They apply alongside our Privacy Policy and our Shipping & Returns Policy, both of which are incorporated here by reference. If you do not agree to these terms, do not use the site or order from us.
2. Eligibility
You must be at least 18 years old, or the age of majority where you live, to place an order. By ordering, you confirm that you meet this requirement and that the payment method you use belongs to you or that you have permission to use it.
3. Accounts
You may check out as a guest or create an account. If you create one, keep your password confidential and tell us promptly if you suspect unauthorized access. You are responsible for activity that occurs under your account. Provide accurate information and keep it current — a stale shipping address is the single most common cause of an order going astray. We may suspend or close accounts used for fraud, abuse or repeated chargebacks.
4. Orders and acceptance
Placing an order is an offer to buy. Your order is accepted when we send a shipping confirmation, not when the site displays an order confirmation or when your card is authorized. Until then we may decline or cancel an order, in whole or in part, including where:
- the item is out of stock or a batch fails our quality checks;
- a price, description or promotion was published in error;
- we cannot verify the payment method or billing details, or the order is flagged as fraudulent;
- the order appears to be for resale rather than personal use;
- we cannot lawfully ship the item to your address.
If we cancel an order after taking payment, we refund the amount charged in full to the original payment method.
5. Pricing, payment and tax
Prices are listed in US dollars and may change without notice. The price that applies to your order is the price displayed at the moment you complete checkout. Shipping charges and applicable sales tax are calculated at checkout and shown before you pay.
We accept the payment methods displayed at checkout. You authorize us and our payment processor to charge the full order total, including shipping and tax, to the method you provide. If a pricing error is obvious — a bottle listed at a small fraction of its normal price, for example — we may cancel the order and refund you rather than honour it.
International customers are responsible for any customs duties, import taxes and brokerage fees charged on arrival. These are not included in our prices and we cannot estimate them for you.
6. Promotions and discount codes
Unless a promotion says otherwise: one discount code per order; codes cannot be combined; codes have no cash value and cannot be redeemed for cash; codes apply to product subtotal only, not shipping or tax; and codes cannot be applied retroactively to an order already placed. We may end or modify a promotion at any time, and we may void orders where a code has been obtained or used in a way it was not intended.
7. Shipping and delivery
Processing times, carriers, rates and delivery expectations are set out in our Shipping & Returns Policy. Delivery dates are estimates and are not guaranteed. Title and risk of loss pass to you when the carrier takes possession of the parcel, though we will still help you pursue a claim for a package lost in transit as described in that policy.
Alcohol-based fragrance is classified as a limited-quantity flammable liquid for shipping purposes. This restricts which services we can use and means some destinations, including certain international addresses, military addresses and expedited air services, may be unavailable.
8. Returns and refunds
All sales are final. We do not accept returns or exchanges, and we do not refund a purchase because you did not like the scent. If your order arrives damaged, incorrect or defective, we will make it right. The full terms, including the reporting window, are in our Shipping & Returns Policy. Buy a sample before you buy a bottle.
9. Product descriptions and images
We describe our fragrances as accurately as we can, but scent is subjective and descriptions are interpretive rather than technical. Note pyramids describe the materials and impressions in a blend; they are not a full ingredient list and not a promise of how a fragrance will read on your skin. Skin chemistry, climate, application amount and your own nose all change the result.
Because we blend in small batches, minor variation between batches is normal and expected. Colour can shift slightly over time with exposure to light and air without affecting the fragrance. Product photography is representative; screen colour rendering varies, and bottle, cap and label details may change between production runs.
10. Safe use of fragrance
For external use only. Do not ingest. Perfume is alcohol-based and flammable.
If you have sensitive skin or a history of fragrance allergy, patch test before general use.
- Patch test. Apply a small amount to the inside of your forearm and wait 24 hours before wearing a fragrance more broadly. Discontinue use if irritation, redness or itching develops.
- Avoid eyes and broken skin. If product enters the eyes, rinse thoroughly with water. Do not apply to cuts, rashes or irritated skin.
- Keep away from flame and heat. Do not spray near open flame, lit cigarettes or heat sources. Do not store in a hot car or in direct sunlight.
- Keep out of reach of children and pets. Some fragrance materials that are safe on human skin are not safe for animals to ingest or be sprayed with.
- Citrus and photosensitivity. Some citrus-forward blends can increase sensitivity to sunlight. Avoid direct sun exposure on freshly sprayed skin.
- Pregnancy and medical conditions. If you are pregnant, nursing, or have a skin or respiratory condition, consult a healthcare professional before use.
- Surfaces and fabrics. Fragrance can stain or damage some fabrics, finishes, plastics and jewellery. Spray on skin, and let it dry before dressing.
Our products are cosmetics, not drugs. Nothing on this site is a medical claim. Our fragrances are not intended to diagnose, treat, cure or prevent any condition, and no statement about mood, wellbeing or effect should be read as one. If you experience a serious reaction, stop using the product and seek medical advice.
11. Ingredients, testing and compliance
Our blends are formulated to avoid materials prohibited under current IFRA standards, and neither Rotten Fragrances nor our material suppliers test on animals. Full ingredient and allergen information is provided on product packaging in the form required by the market in which the product is sold. If you need to know whether a specific material appears in a specific fragrance before you buy, ask us and we will tell you.
You are responsible for checking product information against your own known allergies and sensitivities.
12. Discovery sets and samples
Discovery sets and individual samples are sold as standalone products. Their purpose is to let you test a fragrance before committing to a full bottle. Buying a sample does not create credit toward a later full-bottle purchase, and sample purchases are subject to the same all-sales-final policy as everything else. Sample fill volumes are approximate.
13. Reviews and content you submit
We publish reviews from verified orders and we do not edit them to be nicer. When you submit a review, comment, photo or other content, you grant Rotten Fragrances a non-exclusive, worldwide, royalty-free, perpetual licence to use, reproduce, display and distribute that content in connection with our business, including in marketing, with attribution to the display name you provide.
You confirm that the content is your own, that it reflects your genuine experience, and that it does not infringe anyone's rights. We may decline to publish or may remove content that is unlawful, defamatory, harassing, obscene, contains personal information about someone else, is spam or advertising, or is submitted by someone who did not buy the product. Removing a review is not something we do because it is negative.
14. Intellectual property
The site and its contents — including text, product copy, photography, illustration, layout, brand names, fragrance names, logos and taglines — are owned by Rotten Fragrances or its licensors and are protected by copyright, trademark and other laws. You may view and print pages for your personal, non-commercial use. You may not copy, republish, scrape, sell or use our content or branding for commercial purposes, or use it in a way that suggests we endorse or are affiliated with you, without our written permission.
Our fragrances are original formulations. We do not produce clones, dupes or reinterpretations of other houses' scents, and we do not claim any affiliation with brands whose products ours might be compared to.
15. Acceptable use
You agree not to:
- use the site for any unlawful purpose or in breach of any applicable law;
- attempt to gain unauthorized access to the site, its servers, or any account that is not yours;
- introduce malware, or interfere with the site's operation or security;
- scrape, harvest or systematically extract data, product listings or customer reviews, whether by automated means or otherwise;
- use automated tools to bulk-purchase limited releases or circumvent purchase limits;
- resell our products as a distributor or retailer without our written agreement, or misrepresent our products as your own;
- submit false information, fraudulent payment details, or reviews you did not write.
We may suspend or terminate your access to the site at any time for breach of these terms.
16. Third-party links and services
The site links to and relies on third-party services, including payment processors, shipping carriers and social media platforms. We do not control those services and are not responsible for their content, terms or availability. Your dealings with them are governed by their own agreements.
17. Affiliate program
Participation in our affiliate program is subject to the separate program terms provided when you join. Affiliates must disclose their relationship with us clearly wherever required by law, including under the US Federal Trade Commission's endorsement guidelines, and may not bid on our brand terms in paid search, use spam or unsolicited email, or make claims about our products that we have not made ourselves.
18. Disclaimer of warranties
The site is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site will be uninterrupted, error-free or free of harmful components, or that any defect will be corrected.
Nothing in these terms excludes or limits any warranty, right or remedy that cannot lawfully be excluded, including rights you may have as a consumer under the laws of your jurisdiction.
19. Limitation of liability
To the fullest extent permitted by law, Rotten Fragrances and its owners, employees and suppliers will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data or goodwill, arising out of or relating to your use of the site or our products, whether based in contract, tort, strict liability or otherwise, even if we have been advised of the possibility of such damages.
Our total aggregate liability for any claim relating to an order will not exceed the amount you paid for that order.
These limits do not apply to liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or to any other liability that cannot be limited under applicable law. Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so parts of this section may not apply to you.
20. Indemnification
You agree to indemnify and hold harmless Rotten Fragrances and its owners and employees from any claim, loss, liability or expense, including reasonable legal fees, arising from your breach of these terms, your misuse of the site, or content you submit.
21. Governing law and disputes
These terms are governed by the laws of the State of Wyoming, without regard to its conflict of laws rules. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Sheridan County, Wyoming, and you consent to the jurisdiction of those courts. If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory consumer provisions of your local law.
Before filing anything, please contact us. Most problems we have ever had with an order were solved by an email.
22. General provisions
- Severability. If any provision is found unenforceable, the rest remains in effect.
- No waiver. Our failure to enforce a provision is not a waiver of our right to enforce it later.
- Assignment. You may not assign these terms. We may assign them in connection with a merger, acquisition or sale of assets.
- Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control, including carrier disruption, supply shortages, natural disasters and government action.
- Entire agreement. These terms, together with the Privacy Policy and Shipping & Returns Policy, are the entire agreement between us regarding the site and your purchases.
23. Changes to these terms
We may update these terms at any time. The current version is always posted on this page with a revised "last updated" date. Changes apply to orders placed after they are posted; the terms in effect when you ordered govern that order. Continued use of the site after an update means you accept the revised terms.
